Where Riverdale slip-and-fall cases happen

The pre-war elevator co-op buildings along the Henry Hudson Parkway, including the dense cluster in Central Riverdale, produce stairwell falls, lobby tile falls, and falls in the building entry transitions where the parking garage meets the lobby. Many of these buildings date from the 1930s and 1940s, with original marble stairs, brass railings, and tile lobbies. Worn nosings, loose handrails, and water tracked across lobby tile during rain are the recurring conditions. The co-op corporation is typically the named defendant, and the building's liability insurance usually carries adequate coverage for serious injury claims.

The 231st Street commercial strip under the elevated 1 train, including the Broadway intersection, produces sidewalk falls outside the small retail and at the entry transitions to Marble Hill. The columns of the elevated cast permanent shadows that conceal sidewalk hazards, and the strip's small commercial owners maintain the abutting sidewalks inconsistently. The Riverdale Avenue commercial blocks further north produce a separate cluster, with falls outside cafes, kosher markets, and small retail.

The third cluster is geography-specific: the steep cross-streets in winter. Kappock Street, the streets descending toward the Hudson, and the residential blocks above the Henry Hudson Parkway produce slip-and-fall claims when ice and snow are not properly cleared. The four-hour clearance rule under NYC § 16-123 applies, and the steep grade often makes a partial clearance ineffective. Falls on driveways and walkways at single-family homes in North Riverdale follow common-law premises-liability rules and depend on whether the property is owner-occupied. NYC sidewalk law and adjacent property owner liability

NYC Administrative Code § 7-210 makes the owner of the property abutting the public sidewalk responsible for keeping it in reasonably safe condition. In Riverdale, that owner is most often the co-op corporation, the apartment-building owner, or the commercial-building owner along 231st Street, Riverdale Avenue, or Johnson Avenue. The City of New York is generally not the right defendant.

Owner-occupied one- and two-family homes remain under City responsibility for the public sidewalk in front, and this exception is more significant in Riverdale than in most NYC neighborhoods because of the heavy single-family stock in North Riverdale. The City retains liability for tree-pit defects and certain hardware. Utility-owned grates shift liability to the utility company, NYC Water, or Verizon.

For falls at the 1-line stations (Van Cortlandt Park-242 St, 238 St, 231 St), at the Metro-North stations (Riverdale and Spuyten Duyvil), in Van Cortlandt Park, or at any other government property, General Municipal Law § 50-e requires a Notice of Claim within 90 days. Lawsuit must be filed within one year and 90 days. The Henry Hudson Parkway is a state-controlled roadway, which adds NY State as a possible defendant for highway-related falls and creates additional procedural requirements through the Court of Claims.

What to do after a slip-fall in Riverdale

  1. Get medical attention. Allen Hospital (NewYork-Presbyterian) at the Manhattan line at 220 Broadway is the closest ER for most of Riverdale. Montefiore Medical Center further east is the alternative.
  2. Photograph the hazard, including the slope or grade of the walkway if relevant, the weather, and your injuries. Save your shoes.
  3. Get witness contact information. The doorman, the neighbor across the hill, the dog walker.
