Where Jackson Heights slip-and-fall cases happen

The Roosevelt Avenue corridor between 74th Street and Junction Boulevard produces the highest volume of falls in the neighborhood. The elevated 7 line columns, the inconsistent maintenance across the small commercial owners along the avenue, and the constant bus and rideshare activity at 74th Street-Broadway (one of the busiest transfer points in the city) all combine to produce sidewalk and entryway falls. Restaurants and groceries along 74th Street, particularly the South Asian commercial strip, generate a steady volume of trip-and-fall claims at the doorway transitions.

The 1920s garden-apartment buildings along the avenues 35th to 37th produce a different case profile. These are six- and seven-story pre-war buildings with original interior stairs, tile floors, and brass-railing details. Worn marble treads, missing or loose handrails on the service stairs, and water tracked across lobby tile that the porter never put a mat on are the recurring conditions. Many of these buildings are co-ops, and the co-op corporation is the named defendant.

The third cluster is along 37th Avenue and Northern Boulevard. The 37th Avenue commercial strip has heavy weekend foot traffic for the Colombian, Ecuadorian, and Mexican restaurants, and 37th Avenue's reconfigured curb extensions have created level changes that have produced trip claims. Utility-owned grates shift liability to the utility company, NYC Water, or Verizon. The stamped marking on the cover identifies the responsible utility.

For falls on MTA property at 74th-Broadway, 82nd Street-Jackson Heights, 90th Street-Elmhurst Avenue, on NYCHA property, or in any City park, General Municipal Law § 50-e requires a Notice of Claim within 90 days. Lawsuit must be filed within one year and 90 days. These deadlines are hard.
